Consumer Complaints and Deceptive Trade Practices
As one local attorney has described it, “A deceptive trade practice is any time a business takes money from a customer by lyin’, cheatin’, or stealin’”.
Large companies have a very strong advantage over the customers to whom they sell products. They have superior bargaining power over their customers, and superior knowledge about the products and services they sell. While this is the nature of the modern marketplace, sometimes a company or a salesman goes too far and makes misleading representations about a good or service they are selling. In some circumstances, a company may clearly lie about a good or service they provide, or take advantage of their superior knowledge to a grossly unfair degree. By an overwhelming majority, most of the consumer complaints we have encountered involve the two most important and expensive purchases an individual can make – automobiles and homes.
There are a number of laws that protect consumers from specific acts that the Texas Legislature has deemed to be deceptive or unfair. Texas has also adopted the Deceptive Trade Practices Act, which is very broad, and covers any unfair or deceptive act which is not specifically covered by a separate act.
